Does copyright apply to Internet materials?

Yes.  Copyright laws are applicable to any original work fixed in a tangible form no matter what the medium is.  Print, analogue, and digital materials are all protected by copyright.  The assumption must be made that the Web site is an original work of authorship which is fixed in HTML coding and is therefore automatically protected by copyright.  Further, all of the exclusive rights granted to a copyright owner apply to the owners of web pages.

If for example you see something on BT Yahoo you are strictly forbidden to use it for anything other than your own private use.  See the following extract from their Terms and Conditions.

11. When we provide you with content

11.1 As part of the service we may provide you with applications, data, information, video, graphics, sound, music, photographs, software or any other material. This content is always changing as we try to provide you with the best possible service, and therefore you may notice changes in the content that you can access.

11.2 The content we provide to you can only be used for your own purposes and is protected by copyright, trademark and other intellectual property rights. You are not allowed to copy, store, adapt, modify, transmit, distribute externally, play or show in public, broadcast or publish any part of the content.

11.3 Although we take precautions, we cannot guarantee the accuracy or completeness of the content. For this reason, your use of the content (for whatever purpose) is at your own risk.

11.4 Some of the content will have its own terms and conditions. These may be displayed online or elsewhere. If you access this content you will need to comply with those terms and conditions. You should be aware that any content provided on a subscription basis as part of the service will cease when this contract ends.

Similar terms and conditions apply to almost every source of information found on the web.  However if after exhaustive searching you can find nothing then the following legal statements apply.

Copyright protection

Many people assume that everything posted on the Internet is public domain, probably because our law used to protect published works only if they displayed the proper copyright notice upon publication. The law, however, has changed: neither publication nor a notice of any kind is required to protect works today. Simply putting the pen to the paper or in the electronic medium, putting the fingers to the keyboard creates a copyrighted work. Once expression is committed to a tangible medium (and computer media is considered tangible), copyright protection is automatic. So, postings of all kinds are protected the same as published printed works.

The scope of the implied license to copy, print and distribute

Whenever an author posts anything to the Internet, he or she should reasonably expect that it will be read, downloaded, printed out, and perhaps forwarded on a limited basis. The author implicitly grants a limited license to users to utilize the work in this manner. Think about the rights a newspaper editor has to publish a "letter to the editor." The author of the letter probably did not include a line in the letter giving the editor permission to publish the letter, but anyone who sends such a letter must be presumed to understand that this is what happens to letters to the editor.

On the other hand, most authors would not think that posting a work gives consent to any commercial use of it without permission. This is not part of what one reasonably expects, and so not part of the implied license.
